If not inhibited, man does have free will, as mental disability or disease remains the only true restriction of man’s free will. In instances such as those, genetics certainly come into play, but otherwise, one’s genes do not completely define their actions. The question of free will is not only disputed within the scientific community but also remains well-debated by students of philosophy. In Genome, author Matt Ridley blends the two factions of genetic determinism and freedom, stating that the idea that behavior is entirely mastered by an individual’s environment is just as deterministic as that of genetic determinism. Philosophers often argue that an individual is created by their surroundings, which include the environment in which they reside and exist in and the other human beings with which they interact. They also contend that free will is a human reality that is closely tied to the philosophical concepts of free action and moral responsibility. These philosophers’ idea of environmental influence on an individual’s personality has proven to be valid. However, the idea that people can be genetically predisposed to particular personality traits has the potential to hold equal validity. â€Å"It did not occur to him that he was applying a double standard: demanding rigorous proof for genetic explanations of behavior while easily accepting social ones.† (Ridley, 303) Several studies have shown that an affinity for violence or impulsivity might be linked to specific genes. Another variable that can contribute to one’s personality and mental chemistry is diet, particularly cholesterol intake. Lower cholesterol levels lead to lower serotonin levels, which can possibly indicate depression or violent desires. Ridley makes the point that â€Å"human behavior is, therefore, unpredictable in the short term, but broadly predictable in the long term†. (Ridley, 312) This is true and also acknowledges the fact that humans do have free will. Of course, humans follow a pattern, everything in nature follows a pattern, from the petals of flowers to the shell of a snail and to the migration of geese. Patterns are found everywhere in nature. This doesn’t mean any less that we have free will. I am able to make choices every day. While if observed over a long period of time, my choices might be predictable, it doesn’t take away from the fact that it is my choice. For example, I can choose to buy potato chips every day with lunch. Observed over a long period of time, I am predictable. Still, if I buy them every day, it is my choice, and it does not take away my free will. I can choose not to buy the chips. I am not forced by society or by my genes to buy potato chips. If one day, I decide to buy a cookie instead of chips, it is my choice. It might seem like my choice is limited by my environment, which would be, at that present moment, a school lunch kiosk. There are only a certain number of snack options available. However, this limitation is an illusion imposed by routine, as I do not have to buy a snack from school at all. I do not have to eat a snack either, but if I want to, I can also pack something from home. I have a massive array of choices, and I must choose to do something, even if that something is to do nothing. If I think ahead, I could even buy strawberries the night before and pack them to bring to school.† We call these differences personality, a word that means more than just character. It means the innate and individual element in character.† (161) The decision of what to eat I depends solely on how I eat, whether or not its healthy, cheap, or just easily available. A point that is often made which relates to the issue of whether or not we have free will uses Hume’s Fork as support. Hume’s fork states that â€Å"either our actions are determined, in which case we are not responsible for them, or they are the result of random events, in which case we are not responsible for them.† Who are our choices determined by if not ourselves? It should be clear that if our choices are determined by us, then we are responsible for them. Therefore, the first point Hume makes is ill-supported and unclear. Our actions are not predetermined. We are humans, we think consciously and we are responsible for the consequences of each of our actions. In fact, we are faced with infinite choices daily, which all lead down different paths, which lead to more choices, in an everlasting cycle. We choose to take actions, which result in consequences, which might lead to other choices later on. Additionally, the idea that an individual’s actions are caused by random events is laughable. Of course, an individual’s environment is up to chance and is definitely a result of random events. A person cannot help the circumstances into which they were born. However, how an individual reacts to this environment is entirely up to them. What some consider being fate is the outcome of everyone exercising their free will and the impact of those choices on everyone else’s choices. â€Å"Simple introspection tells me there is nothing that I cant help myself doing. There is equally nothing that says that I must do one thing and not something else.† (Ridley, 302) Every person is born into a different environment which shapes them and offers them an infinite variety of options. â€Å"Yet even after these discoveries, an environment is still massively important probably in total more important than genes in nearly all behaviors.† (Ridley, 306) This environment is influenced by the choices of prior humans, certainly, and by the circumstances in which humanity exists. The choices that humanity has made prior to now has had consequences that affect humanity now. However, how an individual in his right mind responds to his environment is entirely his choice. A person can have genetic limitations set in place, such as certain diseases. These too can be considered part of the environment that they are born into. Choice still exists though one’s environment might affect the types of choices that are available for a given individual. If I have a genetic disease, I am limited by my environment. However, I still have a cognitive mind that allows choice. â€Å"The devastating loss of memory and of personality that accompanies old age in so many people — and that occurs in a few people when quite young has been attributed to all sorts of factors, environmental, pathological and accidental.† (261) Some things we can control, but other things we can’t. The choice is, therefore, not determined by one’s genetics or by the environment, but by the individual. The circumstances of existence are determined by genetics and environment, but not what man does with his circumstances. After all, â€Å"everybody has a unique and different endogenous nature. A self.† (Ridley, 313) What man does with himself is his choice.

After hiring Technicalities Ltd. placed Maisy with Innovative Storage (IS), who is a client of the Technicalities Ltd. Rule It is known that an employee is a person who has been hired by a company to provide service to that particular company on a regular basis in exchange for a monetary consideration and does not provide any such services on behalf of any independent business. The contract for the employment can be either in express or implied form, written or oral with all the rights and duties mentioned in it (Fairwork, 2016). There is a contract between the Technicalities and Maisy at the time of hiring her which consists of the duties and obligations of the parties to the contract. The control test can be used in this case. It is the case where by using common law rules, it can be determined whether any relationship between the worker and the concerned firm exists or not. Under this test, the employer possesses the right to direct the employee for what to do, and where to do the job. To understand the whether a person is an employee or an independent worker, it is better to take a multi factor test. The factors that are included in this test are: Control over the task performed- if controlled by the company, it is an employment. Tools ownership- if owned by workers, than it is independent contractor Wages paid- if paid as per task indicates independent worker Work hours- the standard hours determines employment Duration of contract- if unknown indicates employment Freedom of working for others indicates independent contractor. Application In this case, Maisy is an employee of the Technicalities Ltd. This is because; she has been hired by the Technicalities Ltd. to provide services to the company. It is, therefore, determined by the control test that Maisy is the employer of the Technicalities and there is a relationship of employer and employee existing between her and the said firm, and also the concerned firm has placed her with the IS and directed her about the work she has to do and all. This can be made more specific by applying the multi factor test. Maisys work is control by the company that indicates employment. The tool used by her is owned by the company. Duration of the contract between her and Technicalities is also unknown which leads to employment. She did not even have the authority to delegate any work. Therefore, she is an employee. There are also some facts that state that she i s an independent worker as she herself is paying the tax. But there is nowhere mentioned that she is paid as per the work like an independent contractor. Conclusion Maisy is an employee of the Technicalities Ltd. and she is bound to provide services according to the work given to her by Technicalities. She may be confused with an independent contractor as an independent contractor get paid as a freelance as per the completion of the task. An independent contractor take the liability of own work and has the authority to delegate work. Maisy does not have any such right. Hence, she is an employee of Technicalities Ltd. Conclusion It is known that any organization or agency, or institution gives employment or hires any person for doing the work as prescribed by the organisation, it is called to be an employer. The Technicalities is a labour Hiring company, it has hired Maisy and was placed with Innovative Storage, which is the prescribed work for Maisy by the Technicalities. Therefore, the Technicalities Ltd is the employer in this case. Assuming Maisy is an employee, has Maisys employer breached any contractual duty owed to her? Issue Maisy had an accident in the workplace as she happened to be slipped and fell down from some stairs while carrying some office equipment, due to spill. She had got injuries and took two weeks off and the medical expenses were reimbursed by the Innovative storage as asked by her. She applied for a job but did not get any information regarding the position by the IS. Rule The Fair work Act 2009 and the Fair Work Regulations 2009 are the legislations that govern the employee and employers relation in Australia (Austii, 2016). This case is also governed by the Fair Work Act 2009 (Legislation, 2016). The employers are bound to follow the National Employment Standards (NES) which has also been mentioned in the Fair Works Act, (Legislation, 2016). The National Employment Standards are the 10 minimum employments that should be provided to all the employees by the employer. The 10 National employment standards entitlements are: Maximum weekly hours Requests made for flexible working arrangements. Parental leave and related entitlements, (Ieuvictas, 2016). Annual leave Personal or careers leave and compassionate leave Community service Leave (Awu, 2016). Long service Leave Notice for Termination and redundancy, (Fwc, 2016). Public holidays (Fairwork, 2016). The employer should provide Fair Work Information Statement which can be avail from the Fair Work Ombudsman to all the employees who are new comers to the organization. The Work Information Statement contains all the information about the- Modern awards Agreement making The National Employment Standard Workplace rights and freedom of association The right of entry The termination of the employment Individual flexibility arrangements Any transfer of business The role of the Fair Work Ombudsman The Role of the Fair Work Commission (Fwc, 2016). But in this case only the entitlement of getting the annual leave, medical expense, redundancy and the duty of care is applicable. Annual leave- an employee is entitled to get an annual paid leave for up to four weeks and an additional leave for a week as requested by the employee. Medical expense- the employers are bound to take care of the health and safety of all the employees. The employers have the obligation to take care of the medical expenses and provide all the facilities that is needed by any of the employee. Notice for termination and redundancy- for terminating any employee from the service, the employer should provide a notice of 4 weeks before the termination or redundancy. Any employee who is above 45 years of age or have provided service to the organization for more than 2 years should be provided with an additional week of notice including the four weeks. An employer is also liable to the duty of care. The duty of care is the term that is used in law of tort that indicates the condition when a person is liable. Duty of care is nothing but to take care and prevent a foreseeable harm that can cause to a person. It is also termed as Negligence in tort. If the claimant proves that the defendant has breached the duty of care by not taking any reasonable step to prevent the injury, the defendant will be liable to compensate the claimant. Application Here Maisy was not getting any paid leave even if she takes any sick leave or carers leave. The employer is bound to provide her with paid leave for four weeks in a year. The Technicalities Ltd. being the employer should look into the matter. The Technicalities should have followed the National Employment standards. But it is not following any standard. It is not even providing the Fair work Statement Information to its employee which is a breach according to the legislation of the Fair works Act 2009. She even paid the taxation for her salary and also contribute for the superannuation. But this is the responsibility of the employer to provide the superannuation. The Innovative Storage is also responsible as they have not provided any kind of information regarding any application made for any other position. Though they have paid her for the lack of information, she was not getting any further work by both the Innovative storage and her employer the Technicalities ltd. Before the red undancy made by the Technicalities, the employer should have provided Maisy with a notice for a period of four weeks prior to the redundancy. The IS and Technicalities are responsible for the breach of duty of care that has been caused to her. The IS should have prevented the harm and injury that has caused to Maisy as it was foreseeable and could have been prevented. The IS could have taken proper step to clean and mopped the oil properly so that no one slips from the stairs because of the oil. Conclusion Therefore, the employer has done breach contractual duty towards Maisy as no information regarding the pros and cons for applying for other position in the IS was provided in the contract of her employment by the Technicalities Ltd. and also a breach of duty of care has been done by the employer for which it is liable to compensate Maisy for the negligence which caused injury to her and she was forced to take leave for two weeks. World War Ii Before World War II broke out the world took a backseat ride during Hitler's rise to power. The entire world didn't think that he would become as influential as he became. Hitler achieved his power by relying on the navieness of the world to sit back and allow him to do as he pleased. The world was too concerned about political, economic and militant unrest to worry about a yelling German who thought we would rule the world. Before and during the war, the world was concerned about the economic system. Since ever since World War I, the world countries have been in and out of depressions, no one wanted another costly war. The United States, which was in the Greatest Depression of all, was deep engulfed in its isolationist policy. The US didn't want war, especially after the last one they fought with huge causalities and huge amounts of money spent. The citizens of the US didn't want another war because they knew that another war would cause another depression and that was something that the people didn't want. Even thought the war would create jobs, and put the economy back into a war boom, the American public didn't want to have to deal with the downsides of a war. The major downside being the huge economic toll it would take on the government, which would be fighting on two oceans on different sides of the world. It would become very costly to maintain war and win too. The world also had enormous political concerns. The US was in a period of isolationism and they wanted no part of anything else in the world, except the Western Hemisphere. With Germany's rise of Nazism, the world responded with fascist parties popping up in every nation across the world. Hitler has spread his beliefs into every county in the entire world, exactly what he wanted. These parties responded to every action that their leader took, they helped him scout out a specific country and infiltrate that country's government. These parties believe in Hitler and did whatever he told them to do, including in the United States. After the countries realized Hitler's power they all formed different alliances. The German's allied with Italy and Japan. The US allied with Great Britain, France, and the Soviet Union. It seemed as though each day another country would sign up with either side. Sometimes, even, countries would agree not to fight each. The pre-war and during the war, militaries from all countries fought a war with superior equipment than in the last war. With the invention of the plane, tank, machine gun spread war supplies all over the globe and allowed each country to empower itself. The US prepared for war by passing a series of congressional acts that enabled the war budget to increase dramatically. These acts also allowed for the US to help other countries without actually engaging in the war. The US supplied Great Britain with supplies and ships without ever declaring war on Germany. Germany's invention of the Blitzkrieg they attacked nations and conquered them in single days. No nation had ever seen tactics like this before, and they worked for Hitler. Hitler's air force was the best in the world, he had the most planes with the best pilots. They were unstoppable. Japan's increase in military power proved itself with the bombing of Pearl Harbor in December. Japan showed off its massive air force that dominat ed and destroyed the majority of the United States Navy fleet. World War II was a war that brought the world together. There wasn't a place on the earth were this war wasn't fought. There wasn't a place on this earth were people didn't take sides, whether with the Allies or the Axis powers. The war brought countries like the United States and the Soviet Union together. However, the war did bring mass destruction the Europe and the massive demise of the people hated by the Nazi's.
